Note on the transfer of data to third countries that are not secure under data protection law, as well as the transfer to US companies that are not DPF-certified

Among other things, we use tools from companies based in third countries that are not secure under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). 8. Audio and Video Conferences

Datenverarbeitung

For communication with our customers, we use online conference tools, among other things. The specific tools we use are listed below. When you communicate with us via video or audio conference over the internet, your personal data is collected and processed by us and the provider of the respective conference tool.

In doing so, the conferencing tools capture all data that you provide/use in order to use the tools (email address and/or your phone number). Furthermore, the conferencing tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants, and other „context information“ relating to the communication process (metadata).

Furthermore, the provider of the tool processes all technical data required to handle the online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speakers, and the type of connection.

Insofar as content is exchanged, uploaded, or otherwise provided within the tool, this content is also stored on the servers of the tool providers. Such content includes in particular cloud recordings, chat / instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.

Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Purpose and Legal Bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves to generally simplify and speed up communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Retention period

The data collected directly by us via the video and conference tools is deleted from our systems as soon as you request deletion, withdraw your consent to storage, or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected.

Handling of Applicant Data

We offer you the opportunity to apply to us (e.g. by email, by post or via an online applicant form). In the following, we inform you about the scope, purpose and use of your personal data collected in the course of the application process. We assure you that the collection, processing and use of your data is carried out in accordance with applicable data protection law and all other statutory provisions and that your data is treated strictly confidentially.

Scope and Purpose of Data Collection

If you send us an application, we process the associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation) and – if you have granted consent – Art. 6(1)(a) GDPR. The consent can be withdrawn at any time. Within our company, your personal data is passed on exclusively to persons involved in processing your application.

If the application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

Retention Period of the Data

If we cannot offer you a position, you decline a job offer, or you withdraw your application, we reserve the right to retain the data you have transmitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. Retention serves in particular for evidentiary purposes in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place once the purpose for further retention no longer applies.

Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the Applicant Pool

Unless we make you a job offer, there may be the option to add you to our applicant pool. In the event of inclusion, all documents and information from the application will be transferred to the applicant pool in order to contact you in the case of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6(1)(a) GDPR). Providing consent is voluntary and is unrelated to the ongoing application procedure. The data subject may withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal retention reasons.

2. Purposes of Processing in Applicant Management

We process your personal data to carry out the application process, in particular to

  • publish job advertisements and receive applications, including online forms;
  • review your documents, manage selection processes („rounds“/status) and prepare decisions;
  • carry out communication/scheduling (e.g. interview invitations);

7. Transfer to Third Countries

A transfer to third countries does not, in principle, take place. Should processing outside the EU/EEA be necessary in individual cases (e.g. by subcontractors), we ensure appropriate safeguards (Art. 46 GDPR, in particular EU standard contractual clauses) and provide separate information.

8. Storage Period & Deletion Concept

  • Application process: until the selection process is completed and any appeal periods have expired.
  • Rejected applications: automatic deletion generally 6 months after completion, unless consent to longer storage (applicant pool) has been given or statutory retention obligations/evidentiary purposes conflict with it.
  • Applicant pool (with consent: 6 months, followed by deletion or renewed consent.
  • Upon hiring, relevant data is transferred to the personnel file and stored in accordance with the statutory retention periods.

9. Necessity of providing the data

Providing your application data is required to assess your suitability and to conduct the procedure. Without this data, we cannot consider your application. Voluntary information (e.g. photo) is marked as such.

10. Automated Decisions/Profiling

A solely automated decision pursuant to Art. 22 GDPR does not take place. The system may use filters/comparisons with requirement profiles to support the screening; the final decision is always made by humans.

11. Security of processing

The applicant management system P&I LOGA Bewerber3 meets the requirements of the GDPR. Among other things, the following are in place:

  • Encryption of Data Transmission (TLS)
  • Access restrictions (role-based authorization concept)
  • Logging of Access
  • Server locations within the EU (provided assured by the provider)
  • Regular updates and security checks

With your consent, we include your data in our applicant pool in order to consider you for suitable future positions.
